TERMS OF SERVICE

Please read these Terms of Service carefully before using our services. By engaging Mojo Digital Agency, you agree to be bound by these terms.

1. Agreement to Terms

By accessing or using the services of Mojo Digital Agency ("Company," "we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services.

These terms apply to all clients, visitors, and users who access or use our services, including website design, booking systems, automation, marketing, branding, and online store development. You must be at least 18 years of age to use our services or participate in any SMS communications program.

2. Services

Mojo Digital Agency provides the following services:

  • Custom website design and development
  • Smart booking system setup and configuration
  • AI automation and chatbot implementation
  • Marketing and growth services (Google Ads, SEO, social media)
  • Branding and visual identity design
  • Online store and merchandise store setup
  • Ongoing monthly management and support

The specific services delivered to each client are determined by the package purchased at the time of payment. All service details are outlined on our website at mojodigitalagency.com.

3. Payment Terms

All setup fees are due in full at the time of purchase before work begins. Monthly retainer fees are billed on a recurring basis on the same date each month following the initial setup.

  • All payments are processed securely through our payment processor
  • Setup fees are non-refundable once work has commenced
  • Monthly retainer fees may be cancelled with 30 days written notice
  • Failure to pay monthly fees may result in suspension of services

4. Refund Policy

We offer a 30-day satisfaction guarantee on our setup work. If you are not satisfied with the delivered product within 30 days of launch, we will work with you to resolve the issue or issue a partial refund at our discretion.

  • Refund requests must be submitted in writing within 30 days of project delivery
  • Refunds are not available after the 30-day window has passed
  • Monthly retainer fees are non-refundable once the billing period has started
  • Deposits and setup fees are non-refundable if work has been completed

5. Client Responsibilities

To ensure successful delivery of services, clients agree to:

  • Provide accurate and complete information on all onboarding forms
  • Respond to requests for feedback, approvals, and content within 5 business days
  • Provide access to necessary accounts and platforms as requested
  • Provide legal ownership or rights to any content, logos, or materials submitted
  • Review and approve delivered work in a timely manner

Delays caused by client inaction may result in project timeline extensions. Mojo Digital Agency is not responsible for delays caused by the client's failure to provide required materials or approvals.

6. Intellectual Property

Upon full payment of all fees, clients receive full ownership of the website and digital assets created for them by Mojo Digital Agency. This includes:

  • Website design and code
  • Custom graphics and visual assets created for the project
  • Written copy and content created specifically for the client

Mojo Digital Agency retains the right to display completed work in our portfolio and marketing materials unless otherwise agreed in writing. Stock photos, third-party plugins, and licensed software remain subject to their respective licenses.

7. SMS and Communication Consent

Mojo Digital Agency operates an SMS messaging program for clients and prospective clients. The following terms apply to all SMS communications:

Program Description: By opting in, you may receive SMS messages from Mojo Digital Agency including appointment confirmations, project updates, and onboarding notifications.

Opt-In: You must affirmatively opt in by checking the SMS consent checkbox on our opt-in form. Consent is never required as a condition of purchasing or using our services. You may use all Mojo Digital Agency services without opting in to SMS.

You can cancel the SMS service at any time. Just text "STOP" to (831) 566-4767. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at hello@mojodigitalagency.com.

Carriers are not liable for delayed or undelivered messages.

As always, message and data rates may apply for any messages sent to you from us and to us from you. You will receive messages based on your engagement with our services and project stage; message frequency may vary. If you have any questions about your text plan or data plan, it is best to contact your wireless provider.

Age Restriction: You must be 18 years of age or older to opt in to SMS communications. By opting in, you confirm you meet this requirement.

8. Third-Party Services

Our services may involve the use of third-party platforms including but not limited to GoHighLevel, Stripe, Google, Meta, and others. Your use of these platforms is subject to their respective terms of service and privacy policies. Mojo Digital Agency is not responsible for the actions, policies, or availability of third-party services.

9. Limitation of Liability

To the maximum extent permitted by law, Mojo Digital Agency shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of data, or business interruption, arising out of or related to your use of our services.

Our total liability to you for any claims arising under these terms shall not exceed the total amount paid by you to Mojo Digital Agency in the 3 months preceding the claim.

10. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the engagement. This includes business strategies, client data, pricing, and internal processes. This obligation survives termination of services.

11. Termination

Either party may terminate the service relationship with 30 days written notice. Upon termination:

  • All outstanding balances become immediately due
  • Completed work will be delivered to the client upon final payment
  • Monthly services will continue through the end of the paid billing period
  • Access to any Mojo Digital Agency managed accounts will be transferred to the client

12. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the State of California. Any disputes arising under these terms shall be resolved in the appropriate courts of California. Our principal place of business is located at 3771 Vista Drive, Soquel, CA 95073.

13. Changes to Terms

We reserve the right to update these Terms of Service at any time. We will notify existing clients of significant changes via email. Continued use of our services after changes take effect constitutes acceptance of the updated terms.
